Terms of Service

These Terms of Service (“Terms”) govern your access to and use of StylistSelect (the “Service”), including our website, dashboard, and embeddable matching widget. By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a business, you represent that you are authorized to bind that business.

1. The Service

StylistSelect provides tools to match a salon’s clients with stylists through a configurable questionnaire and an embeddable widget, together with an administrative dashboard and related analytics. We may update, add, or remove features over time.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized use. You must be at least 18 years old to hold an account.

3. Acceptable use

You agree not to: use the Service unlawfully or to infringe others’ rights; upload malicious code; attempt to gain unauthorized access, probe, or disrupt the Service; scrape or overload the Service; or misrepresent stylist or salon information in a deceptive way. We may suspend accounts that violate these Terms.

4. Subscriptions, trials, and billing

Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. Plans are tiered by the number of stylists you manage. Any free trial converts to a paid subscription at the end of the trial period unless cancelled beforehand. Fees are non-refundable except where required by law. You can cancel at any time; cancellation takes effect at the end of the current billing period. We may change pricing on renewal with reasonable notice.

5. Your data and content

You retain all rights to the salon, stylist, and client data you provide or collect through the Service (“Customer Data”). You grant us a limited license to host, process, and use Customer Data solely to provide and improve the Service and as described in our Privacy Policy. You are responsible for having the necessary rights and notices to collect and process client data through the widget, including any consent required by law.

6. Third-party integrations

The Service can connect to third-party systems such as Phorest. Your use of those systems is governed by their terms, and we are not responsible for their availability, accuracy, or practices. You authorize us to access and exchange data with a connected system to provide the integration.

7. Intellectual property

The Service, including its software, design, and content (excluding Customer Data), is owned by StylistSelect and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You may not copy, modify, resell, or reverse-engineer the Service except as permitted by law.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that matching results will meet every expectation.

9. Limitation of liability

To the maximum extent permitted by law, StylistSelect will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold StylistSelect harmless from claims arising out of your Customer Data, your use of the Service, or your violation of these Terms or applicable law.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms or if necessary to protect the Service. On termination, your right to use the Service ends; we may delete Customer Data after a reasonable period as described in the Privacy Policy.

12. Governing law

These Terms are governed by the laws of [State/Country], without regard to conflict-of-laws rules. The courts located in [Jurisdiction] will have exclusive jurisdiction, except where prohibited by law.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the effective date above and, where appropriate, through additional notice. Continued use of the Service after changes take effect constitutes acceptance.
